Welcome to FindSparx. These Terms and Conditions ("Terms") govern your access to and use of the FindSparx mobile application ("App"), website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. ELIGIBILITY

1.1. You must be at least 18 years of age to create an account and use the Service.
1.2. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement.
1.3. You may not use the Service if you have been previously banned or removed from the platform.
1.4. The Service is intended for personal, non-commercial use only.
2. ACCOUNT REGISTRATION

2.1. You must provide accurate, current, and complete information during registration.
2.2. You are responsible for maintaining the confidentiality of your login credentials.
2.3. You are solely responsible for all activities that occur under your account.
2.4. You agree to notify us immediately of any unauthorized use of your account.
2.5. We reserve the right to suspend or terminate accounts that contain false or misleading information.
3. USER CONDUCT

3.1. You agree to use the Service in compliance with all applicable laws and regulations.
3.2. You shall not:
a) Harass, bully, stalk, intimidate, threaten, or defame any person.
b) Post content that is hateful, discriminatory, violent, sexually explicit, or otherwise objectionable.
c) Use the Service for any illegal purpose, including but not limited to fraud, solicitation, or prostitution.
d) Impersonate any person or misrepresent your identity, age, or affiliation.
e) Upload or transmit viruses, malware, or any harmful code.
f) Use automated systems, bots, or scripts to access the Service.
g) Collect or harvest personal data of other users without their consent.
h) Promote or advertise commercial products or services without authorization.
i) Create multiple accounts or use the Service if you are under 18 years of age.
j) Share or distribute another user's private information without their explicit consent.
4. USER CONTENT

4.1. You retain ownership of the content you post on the Service ("User Content").
4.2. By posting User Content, you grant FindSparx a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute such content in connection with the Service.
4.3. You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third-party rights.
4.4. We reserve the right to review, moderate, and remove any User Content that violates these Terms at our sole discretion.
4.5. You are solely responsible for the content you post and the consequences of sharing it.
5. PREMIUM SUBSCRIPTIONS AND PURCHASES

5.1. FindSparx offers optional premium subscription plans and in-app purchases that provide access to enhanced features.
5.2. Subscription fees are billed in advance on a recurring basis (monthly, quarterly, or as specified) through the applicable app store (Google Play Store or Apple App Store).
5.3. Prices for subscriptions and in-app purchases are subject to change. Any price changes will be communicated in advance.
5.4. By purchasing a subscription, you authorize FindSparx or the applicable app store to charge the payment method on file.
5.5. Free trial periods, if offered, will automatically convert to a paid subscription unless cancelled before the trial ends.
6. CANCELLATION AND REFUNDS

6.1. You may cancel your subscription at any time through your device's app store settings.
6.2. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of the paid period.
6.3. Refunds are handled in accordance with our Refund Policy and the policies of the applicable app store (Google Play Store or Apple App Store).
6.4. In-app purchases of consumable items (such as coins, boosts, or super likes) are generally non-refundable once used.
7. VIRTUAL CURRENCY AND ITEMS

7.1. The Service may offer virtual currency ("Coins") and virtual items (such as boosts, super likes, and other features).
7.2. Virtual currency and items have no real-world monetary value and cannot be exchanged for cash or any form of real currency.
7.3. Virtual currency and items are non-transferable and may only be used within the Service.
7.4. We reserve the right to modify, manage, regulate, or eliminate virtual currency and items at any time.
8. PRIVACY

8.1. Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information.
8.2. By using the Service, you consent to the collection and processing of your data as described in the Privacy Policy.
8.3. We implement reasonable security measures to protect your personal information, but no system is completely secure.
9. LOCATION SERVICES

9.1. The Service may use location data to provide features such as proximity-based matching and discovery.
9.2. By enabling location services, you consent to the collection and use of your location data.

10. INTELLECTUAL PROPERTY

10.3. All trademarks, service marks, and trade names used in the Service are the property of their respective owners.
11. THIRD-PARTY SERVICES

11.1. The Service may contain links to or integrations with third-party websites, services, or applications.
11.2. We are not responsible for the content, policies, or practices of any third-party services.
11.3. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
12. DISCLAIMERS

12.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
12.2. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
12.3. We do not guarantee the accuracy, reliability, or completeness of any user profiles or User Content.
12.4. We do not conduct criminal background checks on users and make no representations regarding the conduct or character of any user.
12.5. You are solely responsible for your interactions with other users. Exercise caution and good judgment when communicating with or meeting other users.
13. LIMITATION OF LIABILITY

13.1. To the maximum extent permitted by law, FindSparx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
13.2. Our total liability for any claims arising from the Service shall not exceed the amount you paid to FindSparx in the twelve (12) months preceding the claim.
13.3. This limitation applies regardless of the legal theory on which the claim is based.
14. INDEMNIFICATION

14.1. You agree to indemnify, defend, and hold harmless FindSparx, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
a) Your use of the Service.
b) Your violation of these Terms.
c) Your violation of any third-party rights.
d) Any User Content you post on the Service.
15. TERMINATION

15.1. We may suspend or terminate your account at any time, with or without cause, and with or without notice.
15.2. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, abusive behavior, or extended inactivity.
15.3. Upon termination, your right to use the Service ceases immediately.
15.4. You may delete your account at any time through the App settings. Account deletion is permanent and cannot be reversed.
15.5. Provisions that by their nature should survive termination shall remain in effect after termination.
16. MODIFICATIONS TO THE SERVICE AND TERMS

16.1. We reserve the right to modify, update, or discontinue the Service (or any part thereof) at any time without prior notice.
16.2. We may revise these Terms from time to time. The updated Terms will be posted within the App and on our website.
16.3. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
16.4. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
17. GOVERNING LAW AND DISPUTE RESOLUTION

17.1. These Terms shall be governed by and construed in accordance with the laws of India.
17.2. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.
17.3. The arbitration shall be conducted in English and held in India.
17.4. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
18. SAFETY GUIDELINES

18.1. Always meet in public places when meeting someone from the Service for the first time.
18.2. Inform a friend or family member about your plans when meeting someone new.
18.3. Never share financial information, passwords, or sensitive personal details with other users.
18.4. Report any suspicious, abusive, or inappropriate behavior immediately through the App's reporting feature.
18.5. Trust your instincts — if something feels wrong, discontinue communication and report the user.
